Terms & Conditions of Custom Production
Governing Custom Garment Manufacturing, Sublimation Printing, Proof Approvals & Orders • Effective Date: 1 January 2026
1. Custom Order Binding Agreement
By placing an order request through the DK BRANDS portal or approving a digital proof, the Customer enters into a binding manufacturing contract with DK Brands (Pty) Ltd. All goods produced are custom-made, personalized, or cut-to-order according to customer specifications.
2. Digital Artwork Proofs & Approval Process
Production commences only after the Customer has explicitly signed off or approved the digital design proof via the Customer Portal.
- Customer Responsibility: The Customer is solely responsible for reviewing all elements of the artwork proof, including spelling of player/student names, numbering accuracy, sponsor logo placements, pantone/color selections, collar types, and garment silhouettes.
- Effect of Sign-off: Once approved, the digital proof is locked into the factory MES pipeline. Any changes requested after proof sign-off are subject to reprint/re-make charges at standard rates.
- Intellectual Property & Trademarks: The Customer warrants that they own or hold valid licenses for all logos, crests, and branding submitted. The Customer indemnifies DK BRANDS against any third-party copyright or trademark infringement claims.
3. Sizing, Measurements & Manufacturing Tolerances
Textile and dye-sublimation manufacturing involves heat pressing (sublimation calenders / flatbeds) which induces natural thermal shrinkage and stretch variance:
- Standard Tolerance: A manufacturing tolerance of ±1.5 cm to ±2.0 cm on finished garment chest, length, and sleeve measurements is standard in the South African textile industry and shall not constitute a manufacturing defect.
- Color Matching: While calibrated RGB-to-CMYK dye-sub profiles are utilized, monitor screens emit light while sublimated polyester absorbs and reflects light. Minor tone differences between back-lit digital screen mockups and physical fabric are within acceptable industry tolerance.
4. Payment Terms & Production Milestones
Unless a formal 30-day corporate trade credit facility has been vetted and granted in writing by DK BRANDS Management:
- A 50% deposit is required upon order confirmation to allocate fabric inventory and initiate custom artwork layout.
- The remaining 50% balance must clear via PayFast, instant EFT, or debit/credit card prior to order dispatch or collection (station gate: Final Payment Confirmation).
- Goods remain the property of DK BRANDS until paid for in full.
5. Delivery, Risk & Sign-off
Delivery lead times are estimates based on factory capacity at the time of proof approval. Risk in the goods passes to the Customer upon handover to the courier or physical collection from the DK BRANDS production workshop. Delivery confirmation requires a valid recipient signature captured on the DK tablet or delivery note.
6. Cancellation & Consumer Protection Act (CPA) Notice
In terms of Section 42(2)(f) and Section 16 of the Consumer Protection Act (Act 68 of 2008), the statutory right of cancellation does not apply to transactions for goods that are made to the consumer's specifications or are clearly personalized. Once printing and cutting have commenced, orders cannot be cancelled or refunded except in cases of verified material manufacturing defects reported within 7 business days of delivery.
